Buying and Protecting Property in Georgia as a Foreigner

A convincing property listing does not establish ownership, the legal condition of a project or the terms of your purchase. Start with the actual asset, seller and documents before committing to a deposit.

Identify exactly what you are buying

Distinguish an existing registered apartment from a future unit in a development, a share in property or a contractual investment product. Obtain the cadastral identifier and clarify the land and building involved. Ask whether your citizenship, the land category or the proposed ownership structure affects eligibility. A city address and a photograph are not enough to identify the right being offered.

Use the Public Registry as a starting point

NAPR provides extracts and information about property rights, ownership-related obligations and public-law restrictions. Match the registered owner and identifier with the proposed seller and agreement. The Civil Code requires a written transaction and registration for acquisition of immovable ownership. A registry extract is important evidence, but does not itself assess construction quality or whether a commercial promise will be performed. Official source: Civil Code of Georgia.

Review the agreement and payment sequence together

Record the price, currency, milestones, completion or handover conditions and consequences of delay. For an unfinished project, ask what legally protects each payment. For a rental, clarify possession, the deposit, utilities and termination. Read all incorporated schedules and management arrangements. Keep negotiation messages and make sure any change you rely on is reflected in the signed documents.

Plan for problems before money changes hands

Agree who will review the records independently, who will handle registration and what happens if conditions are not satisfied. Obtain advice early when the seller's identity, ownership documents or authority to sign is unclear. Confirm any meeting address and local attendance requirements; an online lawyer listed in Tbilisi is not automatically a Batumi office.

Legal review checkpoint

Ask for a written summary of the property checked, records reviewed, unresolved issues and conditions to satisfy before payment. A document review should have a defined scope rather than a general assurance that a property is safe.
